Terms of Service

These Terms are an agreement between you and 13Degrees LLC (“13Degrees,” “we,” “us,” or “our”). By downloading, accessing, or using Opticents or this website, you agree to them.

1. License and permitted use

Subject to these Terms, the Software License Agreement, and applicable store rules, 13Degrees LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Opticents for lawful personal or internal business budgeting.

2. Not professional advice

Opticents is a recordkeeping and planning tool. It does not provide financial, investment, credit, accounting, tax, or legal advice. Calculations and projections depend on your entries and may be incomplete or inaccurate.

3. Beta software

Pre-release versions may contain defects, change without notice, or lose compatibility with earlier builds. Do not use a beta as your only financial record. Keep independent records and export backups regularly.

4. Your data and backups

You are responsible for the information you enter, the security of your device, and every package or report you create. 13Degrees LLC cannot recover data that remains only on your device or decrypt a transfer package without its password.

5. Reports and community submissions

You may submit bug reports and feature ideas that you have the right to share. Do not include confidential financial data, malicious code, unlawful material, or another person’s personal information. You grant 13Degrees LLC a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, and incorporate submitted ideas and non-confidential feedback into Opticents without compensation or attribution.

6. Purchases and refunds

Prices, payment processing, taxes, and refunds are governed by the store where you obtain Opticents. The planned public price is a one-time $4.99 purchase, but pricing may change before release.

7. Intellectual property

Opticents, its original software, brand, text, graphics, and materials are owned by 13Degrees LLC or its licensors. Your own entries and financial records remain yours. Third-party open-source components remain subject to their respective licenses.

8. Disclaimers

To the maximum extent permitted by law, Opticents and this website are provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.

9. Limitation of liability

To the maximum extent permitted by law, 13Degrees LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost data, profits, savings, opportunities, or goodwill. Where liability cannot be excluded, total liability will not exceed the amount paid for Opticents during the twelve months before the event giving rise to the claim.

10. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Mandatory consumer protections remain unaffected.
